Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Side Quest mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Side Quest is a mobile application that provides personalized local activity recommendations ("Quests") based on your preferences, location, and other criteria. The App uses artificial intelligence to generate venue and activity suggestions, which are presented through an interactive scratch-card interface.

Key features of the service include quest discovery based on personalized questionnaires, AI-powered venue recommendations, interactive scratch-off card reveals, quest tracking and completion, and a memory collection dashboard for completed quests.

3. User Accounts

To use the App, you must create an account using Sign in with Apple. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You must be at least 17 years of age to create an account and use the App.

4. Tokens and Purchases

The App uses a token-based system to access quest recommendations. Tokens can be obtained through:

• One-time token pack purchases (5, 15, or 30 tokens)
• Monthly subscription plans (Basic: 30 tokens/month, Plus: 75 tokens/month, Pro: 200 tokens/month)
• Referral bonuses

All purchases are processed through Apple's App Store and are subject to Apple's terms and conditions. Token purchases are non-refundable except as required by applicable law or Apple's refund policies. Subscription plans automatically renew unless canceled at least 24 hours before the end of the current billing period.

5. User Content

When completing quests, you may upload photos to document your experiences ("User Content"). You retain ownership of your User Content. By uploading content to the App, you grant Side Quest a limited license to store and display your content within your personal account for the purpose of providing the service.

You are solely responsible for your User Content and must ensure it does not violate any applicable laws, infringe on third-party rights, or contain harmful, offensive, or inappropriate material.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's servers or networks
• Create multiple accounts to abuse the referral system
• Use automated means to access or interact with the App
• Share, resell, or transfer your account or tokens to another person

7. Intellectual Property

The App, including its design, features, content, and underlying technology, is owned by Side Quest and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Third-Party Services

The App integrates with third-party services including AI recommendation engines, mapping services, and venue data providers. Side Quest does not control these third-party services and is not responsible for their availability, accuracy, or content. Your use of third-party services is subject to their respective terms and conditions.

Quest recommendations are generated using AI and are suggestions only. Side Quest does not guarantee the accuracy, availability, quality, or safety of any recommended venue or activity. You should exercise your own judgment when visiting any recommended location.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SIDE QUEST DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. SIDE QUEST MAKES NO WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY QUEST RECOMMENDATIONS OR VENUE INFORMATION.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIDE QUEST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. SIDE QUEST IS NOT LIABLE FOR ANY EXPERIENCES, INJURIES, OR DAMAGES THAT MAY OCCUR AT VENUES OR DURING ACTIVITIES RECOMMENDED BY THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO SIDE QUEST IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Termination

Side Quest may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time through the App's settings. Upon termination, your right to use the App will immediately cease, and any unused tokens may be forfeited.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App or through other appropriate means. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
